These service terms apply to every use of Gradetonic: the website, the platform at app.gradetonic.com, your viewing rooms on gradetonic.com addresses or your own domain, and the iPad app. You accept them when you create an account.
The NLdigital Terms 2025 apply
Together with these service terms, the NLdigital Terms 2025 apply, the standard terms of the Dutch digital sector: Chapter 1 (General provisions), Chapter 2 (Compliance), Chapter 3 (Cyber security), Chapter 4 (Processing of personal data), Chapter 5 (Data sharing) and Chapter 6 (Artificial Intelligence and Software-as-a-Service). The other chapters don’t apply.
Download them: NLdigital Terms 2025 (English, PDF) · NLdigital Voorwaarden 2025 (Nederlands, PDF). In a dispute about the meaning of the English version, the Dutch text prevails.
These service terms are the explicit written arrangements meant in article 1.2 of the NLdigital Terms: where they differ from the NLdigital Terms, these service terms prevail. In the NLdigital Terms, “supplier” means Gradetonic and “client” means you.
1. Business customers only
Gradetonic is offered only to businesses. When you sign up you confirm that you act in the course of your trade, business or profession. Because of that, the statutory consumer right of withdrawal does not apply.
2. Your account and the free trial
- You need an account, with a company name, to use Gradetonic. Keep your login details private; you are responsible for what happens in your account.
- After you confirm your email address you get 30 free minutes of streaming with up to 5 viewers, valid for 30 days. The trial is one per company. We may refuse a trial when there are signs of abuse, such as repeated sign-ups.
3. Passes
- A pass covers one room with up to 10 viewers and carries Gradetonic branding on a yourname.gradetonic.com address.
- A pass starts at the first minute in which your stream is live and at least one viewer is watching. Setting up, testing your encoder or an encoder left running without viewers does not start a pass.
- The hour pass contains 60 counted viewing minutes: only minutes with live picture and at least one viewer count. The day pass runs for 24 hours and the 3-day pass for 72 hours from the first counted minute.
- A pass must be activated within 12 months of purchase. Passes do not renew.
4. Room subscriptions
- A subscription is per room and includes your own domain, logo, colors and pause screen, and up to 10 viewers per session.
- In deviation from article 4.2 of the NLdigital Terms: monthly subscriptions renew each month and you can cancel them any month, effective at the end of the paid month. Yearly subscriptions renew for a year unless you cancel before the renewal date. Switching between monthly and yearly takes effect from the next period.
- You can add rooms at any time. The price for the rest of the current period is calculated pro rata.
- Fair use is up to 100 streaming hours per room per month. If you regularly need more, we contact you first to find a fit. We never bill extra usage afterwards.
- If a payment fails, everything keeps working for 7 days while the payment is retried. After that your own domain and branding are paused until the payment succeeds.
5. Prices and payment
- All prices are in euros and exclude VAT. For businesses in the EU with a valid VAT number, VAT is reverse-charged.
- Passes are paid in advance with iDEAL, card or Bancontact. Subscriptions are paid in advance by card or SEPA direct debit; the first payment can also be made with iDEAL or Bancontact. Invoices are available in your account.
- In deviation from article 3.5 of the NLdigital Terms: we announce price increases at least 30 days in advance. An increase never affects passes you already bought and applies to subscriptions from the next period.
6. No refunds, but compensation
- Passes and subscription periods are not refunded, including unused time.
- If streaming fails because of a problem on our side, we compensate you: for a pass, its end moves by the time lost; for a subscription, you get a credit on the next invoice.
- What our meter did not count is never charged afterwards.
7. Your viewers
- In deviation from article 38.2 of the NLdigital Terms, you may let the people you invite, such as your clients, directors and collaborators, watch your rooms. You are responsible for who you invite and for passing on viewer passwords and links only to them.
- You will not use Gradetonic to stream content that is illegal or infringes the rights of others, to broadcast to the public or to more viewers than your room allows, or to test the platform’s limits, attack it or reverse engineer it.
8. Your content and confidentiality
- You keep all rights to everything you stream. We do not record or store your streams.
- You make sure you have the rights to stream what you stream and to share it with your viewers.
- We treat your sessions as confidential (article 5 of the NLdigital Terms). We only look at technical data, such as whether a stream is online and how many viewers are connected, to run and support the service.
9. Personal data
Where we process personal data of your viewers on your behalf, Chapter 4 of the NLdigital Terms and our processing appendix together form the processing agreement under Article 28(3) GDPR.
10. Availability and support
We do our best to keep Gradetonic available and to announce planned maintenance in advance (article 38.5 of the NLdigital Terms). Streaming depends on the internet connections of you and your viewers, which we don’t control. We don’t offer a guaranteed uptime; compensation for outages on our side is described in section 6. Support is by email.
11. Suspension and termination
- We may suspend an account when these terms are seriously breached, when payment is overdue after the grace period, or to protect the platform or other customers. We tell you why, unless the law prevents it.
- You can close your account at any time. Running subscriptions end at the end of their period.
12. Liability
Our liability is limited as described in article 15 of the NLdigital Terms.
13. Changes to these service terms
We may change these service terms. We announce changes at least 30 days before they take effect. If you don’t agree, you can cancel before that date.
14. Law and disputes
Dutch law applies. Disputes are resolved as described in article 18 of the NLdigital Terms.
